What is a Statement of Use?
A Statement of Use (SOU) is a legal declaration confirming that a trademark is actively being used in
commerce. It is filed with the Intellectual Property Office (IPO) after a Notice of Allowance is
issued, signaling that your trademark has been approved for registration. The SOU demonstrates
actual use by providing key details such as the first date of use, the goods or services linked to
the mark, and real-world examples (specimens) of the trademark in action.
For “intent-to-use” applications, submitting a Statement of Use is mandatory. It must be filed within
six months of receiving the Notice of Allowance, though applicants can request a six-month extension
if needed. Our team ensures your filing is accurate, timely, and supported with proper
documentation helping you avoid costly errors and keep your registration on track.
